Policies & Rules

POLICIES, RULES AND PROCEDURES

All policies, rules and procedures situated on the Websites (as the same may exist from time- to- time) in respect of your relationship with us are specifically incorporated into the General Terms and Conditions by reference, are deemed to be substantive and material terms thereof and are subject thereto.

These policies, rules and procedures may be amended by us from time- to- time in our sole and unfettered discretion and shall become binding upon you in the same manner and as if the amendments were effected to the General Terms and Conditions.

OPENING AN ACCOUNT

In order to use the Pikum! website, you will first need to register an account with Pikum! This account can be a free-play or real-play account. You can open a free play account with Pikum! by choosing a unique user name and password and entering other information that Pikum! may ask for on the registration form which will include (but not necessarily be limited to) your first and last name, address, email, and birth date. To play for real money on you account, you must complete a second registration form that includes your address and telephone number. The real money registration also requires you to confirm that it is legal for you to wager in your jurisdiction and, if so, that you are of legal age to wager in your jurisdiction. You shall ensure that the details provided at registration are accurate and kept up to date. You can change the details you provide at registration at any time by editing your contact information from the My Bank page. Please see our Privacy Policy for further details. There are no set-up charges for opening your Account.

In deciding whether to accept your money transfers Pikum! may use the information you have given us, or information already held about you, or which we receive from any agencies with whom Pikum! has made any enquiries to confirm your identity. Such agencies will check any details Pikum! may disclose to them against any databases (public or private) to which they have access and will keep a record of such check. You irrevocably agree that Pikum! may process, use, record and disclose personal information which you provide in connection with your registration and that such personal data may be recorded by the credit reference agencies or Pikum!

On registration you are able to select a unique User Name along with your own choice of password. It is solely your responsibility to ensure that you do not reveal your User Name and/or password to anyone else. You are responsible for any entry stakes committed where your User Name and/ or password have been correctly entered.

CLOSING AN ACCOUNT

You may close your Pikum! account at any time by logging into the Pikum! website and visiting the Close Account page where you will be requested to authenticate your identity by inputting the following information: (1) first and last name, (2) Pikum! user name, (3) date of birth, (4) the last four digits of your then current payment method (i.e., bank account or credit card), and (5) your email address that is registered on the system. Any failure to authenticate will prevent you from completing the account closure process. After 3 unsuccessful authentication attempts a 24 hour freeze is placed on your account, you are asked to contact customer service, and an email is sent to notify you that a persistent but unsuccessful attempt was made to change your account status.

If authentication is successful and you have one or more outstanding money Pikums, then you will be notified on the website that you have outstanding Pikums. You will then be given the option to (a) forfeit all bets and any possible winnings made from such bets, or (b) cancel the account closure process. If you choose to forfeit your bets, then any winnings will be donated to a charity of Pikum!s choice or otherwise disposed of according to policy.

If authentication is successful and you have one or more outstanding Pikums open, then you will be notified on the Pikum! website of the outstanding Pikums. If a Pikum has been created by you but has no outstanding money bets, then the Pikum will be closed immediately. If a Pikum has been created by you and has outstanding money stakes on it, then you will be given the option to (a) forfeit all fees that may be payable to you for creating such Pikum or (b) cancel the account closure process. If you choose to forfeit your fees, then any fees will be donated to a charity of Pikum!’s choice or otherwise disposed of according to policy.

If you close your account, then all remaining funds in the account will be returned to you. You may incur a processing fee if a third party payment processor has charged a processing cost, in accordance with Pikum!'s Account Withdrawal policies.

When you close your account, a confirmation email will be sent to your registered email address notifying you that your account has been closed

If you have set any gaming limits on your account, those limits will remain intact when you close your account. If you reopen your account at a later stage and the limits are still within the defined period, they will remain in force until the defined period has lapsed.

Once your account is closed, you will automatically be unsubscribed from all of Pikum!’s e-mail lists (e.g., newsletters, promotional materials, etc.). However, during the close account process you will have the opportunity to opt in to receive future promotional emails from Pikum!

During the account closure process you will be asked to state why you are closing your account and possible reasons will be listed in a pre-defined drop down list.

When your account is closed, you account details will remain within Pikum!s database, but your account status will be changed to Closed. You may re-open your account by filling in a form on the Pikum! website. To re-open your account, you must provide the Company with the same information that was provided at the time the account was closed.

DEPOSIT & WITHDRAWAL POLICY

Deposits

You may deposit additional funds into your Pikum! account at any time, using the electronic payment options provided by Pikum!. Such monies may then be used by you to bet, or pay expenses, on the Pikum! website. Monies deposited in your Pikum! account will not accrue any interest.

Pikum! may at any time unilaterally set- off any positive balance on your account against any amount owed by you to Pikum! (without notice to you).

You can self-impose a deposit limit on your Pikum! account. This limit cannot be increased within a 7 day hold period on changing limits. This limits the total amount of monies which can be deposited into your Pikum! account within a given time period. If, for example, the limit is set to £ 50 per week and you deposit £ 25, then £ 20, the total equals £ 45 in that week. In that case, you cannot deposit an additional £ 5 as that is below the minimum deposit amount and you cannot deposit £ 10 as that is over your limit.

The minimum deposit required to fund a Pikum! account is £10.00 (GBP).

The minimum amount required to re-deposit funds into your account is £10.00 (GBP).

All deposits are made in British Pounds (GBP).

All players have the ability to set their own limits on the Pikum! website. Limits are available to all players to help manage their deposits on the Pikum! website. Limits can be set for daily, weekly, and monthly time periods. You can reduce your limits at any time and the change is effective immediately. You can increase your limits at any time, but the change is only effective after a 7 day hold period has elapsed.

Pikum! has set a maximum amount that you can place at one time on a Pikum at £500. Pikum! has the right to change this limit if it sees fit.

Withdrawals

You may request to withdraw money from your account at any time provided that all payments made have been received and cleared with no holds applicable thereto. Pikum! reserves the right to pay any requested withdrawal in whole or in part via the same method as originally used by you to deposit funds into your account. If the method used to make the deposit does not allow a repayment (e.g., an international Mastercard), then a bank transfer will be used in the relevant instance.

Your account is only allowed to hold one active deposit mechanism at a time. You can only add a new deposit mechanism after you have first withdrawn the entire remaining balance to the original deposit method, which then remains as the only active deposit mechanism.

Any withdrawal, may incur a processing fee, if a third party payment processor has charged a processing cost, which will be deducted from the amount withdrawn. In some cases their bank may levy an additional charge for processing a bank transfer. In some cases your bank may levy an additional charge for processing a bank transfer.

To minimize the risk of fraud or money laundering, Pikum! may request documentary proof of identification from any player before a bank transfer will be processed. For withdrawals greater than £2,000 on any 90 day period (individually or in aggregate), you must provide Pikum! with documentary proof of your identity. Documentary proof will be a form of government- issued photo identification (e.g., passport, national ID, or drivers’ license) and a utility bill showing your current residential address. This documentary proof will be required in the above scenario and when there is a change in address or payment method.

Pikum! offers a range of electronic payment options. If you use a credit card, a debit card, or an e-wallet to make a deposit, Pikum! may (in it’s sole discretion) change the status of the withdrawal request to pending, due to pending investigation into fraud or money laundering or awaiting ID verification documentation from you.

The minimum withdrawal amount from a Pikum! account is £10.00 when you withdrawal part of your account balance. Should you wish to withdrawal all of your money in your Pikum! account you may incur a processing fee if a third party payment processor has charged a processing cost.

It may take up to 14 days from the time that Pikum! has processed a withdrawal from your Pikum account for the money to appear in your payment method account, This may be due to a delay from our payment processor or, investigation into fraud or money laundering or awaiting ID verification documentation from you,

You must ensure that all withdrawals are made to accounts in which you are the named account holder.

If you make a withdrawal from your Account in a currency other than your Account Currency, such withdrawal will be made at the Exchange Rates offered by the payment processor at the time of such withdrawal and may be subject to a small conversion fee. Pikum! has no control over third-party processing methods and fees and assumes no responsibility for your costs or satisfaction with the payment processing methods that you may choose to use.

SELF EXCLUSION POLICY

You have the ability to exclude yourself from the Pikum! website at any time by visiting the player protection page linked from the footer of each page. If you activate the self-exclusion function, the balance of your account must be withdrawn by you, any outstanding bets will continue (a warning shall be given if there are outstanding bets), you shall be removed from all email notifications, you shall be added to the marketing blacklist which prevents you from receiving any future marketing emails or mailings, you shall be logged out of the Pikum! website, a final email shall be sent to you indicating you have excluded yourself from the Pikum! website, and you shall not be allowed to login to the Pikum! website for a period of 6 (six) months from the date of activation of your self-exclusion.

HELP/ CHANGING YOUR PERSONAL DETAILS

If you have forgotten your password you can go onto the Pikum! Website and click on the link “Forgot Password?”. You will be required to complete a form that asks certain security questions. If the questions are answered correctly then you will be able to choose your own new password.

It is your responsibility to inform Pikum! of any changes to your personal details that may be relevant to the use of your account e.g. a change of address. If any of these details change, you can go onto the Pikum! website and click on Edit Profile and change your details, as long as you are logged into the Pikum! website. Alternatively, you can contact the Customer Service Centre to have your details changed once you have correctly answered a set of security questions.

Pikum! may request documentary proof of identification from you when personal details, such as physical address, are sought to be changed by you.

HOSTING RULES POLICY

For the purposes hereof, a “host” is a person who hosts a Pikum.

YOU MAY NOT HOST A REAL MONEY PIKUM IF YOU ARE RESIDENT IN UNITED STATES OF AMERICA.

You may not invite participants to your Pikum! nor market your Pikum! to any party situated in a Restricted Territory. For the purposes hereof, a “Restricted Territory” is any place, country, territory and the like of which we shall advise you from time-to-time. We may amend such list as we deem fit. The current Restricted Territories are all territories outside of the United Kingdom.

All hosts have the option of choosing the entry fee into the Pikum which will range from £2 (the minimum entry fee) to £500 (the maximum entry fee).

A host has the option to choose which events, teams and Piks will be part of his/her Pikum, as long as those events, teams and Piks are available for selection on the Pikum! website. Pikum! works with 3rd parties to obtain and verify (through independent adjudication) the results of each event and is only able to provide those sporting events indicated as being available on the Pikum! website.

Pikum! may (in its sole and unfettered discretion) limit the number of Pikums that a host may host simultaneously.

Pikum! consents to hosts promoting his/her Pikum!(s) on websites under the host’s control. Pikum! provides hosts with a unique URL for each Pikum created, and also offers hosts various widgets that can be embedded into host-controlled web pages. All hosts will ensure that they will not spam others with information on their Pikum or about Pikum!, and agree to always work in good faith and in the best interests of Pikum!. You may not, without Pikums! prior written consent, register any derivative domain name associated with Pikum!’s domain names, websites, services, products or the like. If Pikum! does at any time grant you permission to do so, Pikum! shall impose whatever restrictions and/ or conditions upon such ownership, registration and use as Pikum! (in its sole and unfettered discretion) deems fit.

On registration with Pikum! we shall and hereby grant to you a revocable, non-exclusive, non-transferable license, during the term of your membership of Pikum!, to use our Marketing Material solely for the purposes of giving effect to this Agreement.

Hosts are required to adhere to local laws and regulations regarding the promotion of gaming- related products and to regulations regarding unsolicited mail or spam. In particular, amongst others, hosts are required to adhere to all applicable laws regarding the promotion of online gambling to minors; any government or regulator imposed restrictions on content; and any restrictions regarding promotion in certain geographic areas.

Hosts shall earn a revenue share of any Pikum that they host. Such revenue share shall be a variable percentage of the Vigorish. For the purposes hereof “Vigorish” means a variable rate (based upon a number of variables including, without limitation, the size and nature of the Pikum and entry stake) from each created Pikum deducted from the pot. After Pikum! deducts certain costs associated with the running of the Pikum! from the Vigorish, hosts will become entitled to a share of the balance. The aforementioned revenue shares shall be based upon the following Table (applicable for the period 1 March through 30 June 2008):

Every host starts in “Standard”.

If a host moves up a level, he/ she shall receive revenue share for his/ her new level from that day onwards (for the following year). Whatever the host makes during the course of the following year determines his/ her level for the following year.

Should Pikum! establish (in its sole and unfettered discretion) that any host is violating any of the provisions hereof, Pikum! may immediately lock the host’s account. Pikum! may thereafter (in its sole and unfettered discretion) either unlock or or cancel the hosts’s account. If the Pikum is allowed to continue the host’s revenue share from the Pikum will be given to a charity of Pikum!’s choice. If the Pikum is cancelled then all stakes will be refunded to the relevant accounts of participants in the Pikum.

EDITORIAL POLICY

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials, whether publicly posted or privately transmitted, are your sole responsibility. This means that you, and not Pikum!, are entirely responsible for all content that you upload, post, email, transmit or otherwise make available on or through the Pikum! website. Pikum! does not control the content posted on or through the Pikum! website and, as such, does not guarantee the accuracy, integrity or quality of such content. Under no circumstances will Pikum! be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind suffered or incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available on or through the Pikum! website.

You hereby represent, warrant and agree that no materials of any kind submitted through your Pikum! account or otherwise posted, transmitted, or shared by you on or through the Pikum! website will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.

You hereby agree and undertake to not use the Pikum! website or service to:

  1. add links to external sites outside of fields designated in your profile for that purpose (other than by prior written agreement of Pikum!);
  2. harvest or collect email addresses or other contact information of other players or hosts from the Pikum! website by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
  3. use the Pikum! website in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Pikum! website;
  4. use automated scripts to collect information from or otherwise interact with the Pikum! website;
  5. upload, post, transmit, share, store or otherwise make available any content that we deem (in our sole and unfettered discretion) to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
  6. upload, post, transmit, share, store or otherwise make available any pictures / videos other than those of a personal nature that: (i) are of you or your friends, (ii) are taken by you or your friends, or (iii) are original art or animation created by you or your friends;
  7. impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
  8. upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
  9. upload, post, transmit, share, store or otherwise make publicly available on the Pikum! website any private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers, National ID numbers, and credit card numbers;
  10. upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  11. intimidate or harass another person;
  12. upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
  13. upload, post, transmit, share, store or otherwise make available content that, in our sole and unfettered discretion, is objectionable or which restricts or inhibits any other person from using or enjoying the Pikum! website, or which may expose us or the Pikum! Website’s users to any harm or liability of any type;
  14. impersonate any person or entity, including, but not limited to, a Pikum! official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity.

You may not post, transmit, or share any materials on the Pikum! website that you did not create or that you do not have permission to post. You understand and agree that Pikum! may, but is not obliged to, review the Pikum! website and may delete or remove (without notice) any content or Player content in its sole discretion, for any reason or no reason whatever. You are solely responsible at your sole cost and expense for creating backup copies and replacing any Player content you post or store on the Pikum! website or provide to Pikum!.

Should Pikum! receive any complaint by other players, copyright or trademark owners and/or by legal authorities, Pikum! will remove the content in question, and then investigate the complaint. All complaints should be sent by using our website email form on the home page of the Pikum! Website.You can select the “Content Complaint” category and the complaint will be dealt with as soon as possible. Pikum!’s Editorial department will review the complaint and make a recommendation to the Content Complaint Committee. Once reviewed and agreed, the content will either be restored or permanently removed. Pikum! reserves the right to investigate and take appropriate legal action against anyone who, in Pikum!’s sole discretion, violates Pikum!’s Editorial policy, including without limitation, reporting the player to relevant law enforcement authorities.

ANTI-SPAM POLICY

Pikum! Worldwide Limited is committed to permission-based e-mail marketing practices, and as a result has established this zero-tolerance Anti-Spam Policy.

Pikum! Worldwide Limited conforms to the FEDERAL TRADE COMMISSIONS CANSpam Act and we do not condone the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial e-mail ("Spam").

To ensure our emails comply with this policy, Pikum! Worldwide Limited will:

  • Always include your email address in the e-mail message.
  • Ensure our subject lines are descriptive in nature about the content of the e-mail.
  • Ensure that the "From" line is not a sales pitch or marketing message.
  • Ensure our "Reply" address is active.
  • Will display an unsubscribe link in every e-mail.
  • Honor unsubscribe requests within ten days.
  • If sending email to non-customers and not at the request of our customers, include a physical address.

We always avoid the following e-mail offences:

  • use or contain invalid or forged headers;
  • use or contain invalid or non-existent domain names;
  • employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path;
  • use other means of deceptive addressing;
  • use a third party's internet domain name, or be relayed from or through a third party's equipment, without permission of the third party;
  • contain false or misleading information in the subject line or otherwise contain false or misleading content;
  • fail to comply with additional policies and procedures described below.
  • condone the harvesting, mining or collection of e-mail addresses or other information from or through e-mail Hosting Services.

Pikum! Worldwide Limited imposes penalties on Affiliates who do not comply:

  • If Pikum! Worldwide Limited confirms that our Affiliates are guilty of sending unsolicited Spam, we may, without notice, take such action as we, in our sole discretion, deem appropriate, including blocking messages from a particular internet domain, mail server or IP address.
  • On receiving notification of a valid Spam complaint, and it is the first complaint of this nature, we will issue Affiliates with a warning and advise them to conform to the Federal Trade Commission CANSpam Act. On receiving notification of a second Spam complaint, we will immediately withhold any payment and terminate any Affiliate account linked to transmitting or is otherwise connected with any e-mail that violates this policy.

CHANGING AND CANCELLATION OF PIKS POLICY

Changing Piks

Pikum! allows you to change Piks up until the official start time of the underlying sporting event. Thereafter no further changes to Piks relating to that event are or will be permitted.

If the event is delayed you will not be able to change your Pik unless the event has been rescheduled to a specific date and time and Pikum! has updated the event information in its database.

Cancellation of Pikums

Cancellation by a host

A host may not, without Pikum!’s prior written consent, cancel the Pikum once one or more Players (excluding the host) have been attracted thereto.

Cancellation of a Pikum by Pikum!At any time, and its its sole and unfettered discretion, for any reason whatever, Pikum! may cancel a Pikum.

If Pikum! decides to cancel a Pikum, its sole obligation to the host and Players is to notify them of the cancellation, and to refund them their Entry Fees in full into their respective accounts at Pikum!

Cancellation of a Player’s Participation in a Pikum

Once you have entered a Pikum and made your Piks, you may not cancel your participation therein. Whilst Pikum! permits you to make changes to your Piks according to our Changing Piks Policy, Pikum! does not permit you to withdraw from a Pikum altogether; save if the minimum number of players specified to participate in such Pikum is not achieved. In this event, the Pikum shall be cancelled and the players who chose to participate therein shall have their respective stakes refunded to them.

If Pikum! establishes at any time that you have used fraudulent means to deposit money or are party to any other suspicious activity, Pikum! may (in its sole and unfettered discretion) cancel your participation in a Pikum. All bets placed by you in the above circumstances shall be voided.

ROSTER CHANGE POLICY

Team Rosters are listings of event participants for a particular sporting event. Pikum! permits you to host and play Pikums involving individual athletes/participants.

Team Rosters are subject to change, often on a very short notice. Pikum! updates team rosters in its product as these changes become available, but does not guarantee that a particular athlete/participant will actually take place in a sporting event.

Therefore, it is your responsibility to keep abreast of Roster Changes, and adjust your Piks accordingly.

EVENT CANCELLATION/ DELAY POLICY

Sporting Events are subject to Cancellation or Delay for a variety of reasons outside of Pikum!’s control. If a Cancellation or Delay of a Sporting Event occurs, the following rules shall apply:

Event Cancellation

If an event is cancelled outright, the rule adopted by Pikum! shall depend upon whether a Pikumwas a Single-Event Pikum, or a Multi-Event Pikum. A Single-Event Pikum is a Pikum in which piks relate to a single sporting event (for example, a football game). A Multi-Event Pikum is a Pikum in which piks relate to Multiple Sporting Events (for example, a football game and a Formula One race).

Players in a cancelled Single-Event Pikum or in a Multi- Event in which all events have been cancelled shall (i) be notified that the Pikum has been canceled, and (ii) will receive a full refund of their Entry Fees into their Pikum! Account.

Players in a Multi-Event Pikum in which only one or some, but not all, underlying events have been canceled will (i) be notified that one or more events have been canceled, and (ii) have your Piks relating to the canceled event(s) credited with 100 points (in other words, these Piks will be treated as if every Player in the Pikum had picked the exact, correct result).

Event Delay

Event Delays will normally only impact a Pikum by changing such Pikum’s start time. If possible, Pikum! will notify you of the new event start time, and you will be able to make changes to your Piks until the event begins.

However, should an event be delayed for a period of 72 hours or more, Pikum!, may (in its sole and unfettered discretion) treat an event as if it had been canceled. This decision is binding upon the host and all Players in the Pikum. In this event, we will (i) notify you of our decision to treat an event as canceled and (ii) apply the Event Cancellation policy set forth above.

Event Interruption

In rare cases, sporting events are interrupted, for example, a tennis match due to rain. Provided that the interrupted event actually commenced with play before such interruption occurred, Pikums will remain in place and may not be changed.

However, should an event be interrupted for a period of 72 hours or more, Pikum! may (in its sole and unfettered discretion) treat the event as if it had been canceled. This decision is binding upon the host and all Players in the Pikum. In this event case, we will (i) notify you of our decision to treat an event as canceled and (ii) apply the Event Cancellation policy set forth above.

RESULT AND WINNERS DETERMINATION POLICY

Preliminary Pikum Results

Pikum! obtains data from trusted 3rd parties containing Event Results. Shortly after we receive Event Results, we calculate the Preliminary Pikum Results for any Pikum containing that event. After the Preliminary Pikum Results are calculated, we show the preliminary leaders in the Pikum for the events completed. In addition, all players’ scores and Piks for the completed events can be viewed by anyone at that time.

Once Event Results for all events in a Pikum have been received, the Pikum Preliminary Winner(s) is/ are identified and all Pikum Players are notified according to their communication preferences (email, SMS). The communication contains a link to the view Pikum page where anyone can view the Event Results, all Players’ Pikum Scores and Piks, the Preliminary Pikum Winner(s), and the Preliminary Payout Amount(s).

Preliminary Pikum Winners

While Pikum! and its data partners take great care to ensure the accuracy of Event Results, human and technology errors may occasionally lead to incorrect reporting of Event Results to Pikum!. There may also be occasional situations where Event Results are challenged by Event Participants, the Event’s League / Governing Sports Authority, or other relevant organizations.

Therefore, Pikum! has instituted the following Preliminary Pikum Winners Dispute Policy, which is binding upon all Pikum! Players.

For a period of 24 hours after the Preliminary Pikum Winners have been identified, Pikum! will (in its sole and unfettered discretion) either (i) entertain a Challenge of the Preliminary Pikum Winners from Players of the Pikum only if such Challenge is based on alleged inaccuracies of Event Results; or (ii) issue a Challenge of Preliminary Pikum Winners itself if it (Pikum!) is of the opinion that the Event Results may be or are inaccurate. You can contact the Customer Service Centre by going onto the website and clicking on the “Contact” form to send an email to us detailing the challenge.

If no Challenge of Preliminary Pikum Winners is received or issued during the 24 hour Preliminary Winners Dispute Period, Pikum! will immediately declare the Preliminary Pikum Winners to be final (“The Final Pikum Winners”) and will proceed to credit the winner(s)’ accounts within a reasonable time thereafter. No Challenges of Pikum Winners, Preliminary or Final, will be accepted once The Final Pikum Winners have been declared.

If a Challenge of Preliminary Pikum Winners is received or issued during the 24 hour Preliminary Pikum Winners Dispute Period, Pikum! will analyze the accuracy of Event Results and will make a binding ruling on further steps to be taken during the 24 hour period starting from the time the Challenge was received by Pikum!. Further steps may include (i) a Challenge Rejection, (ii) a Challenge Acceptance and Revision of Results, or (iii) an Imposition of a Continued Evaluation Period.

If Pikum! rejects a Challenge, all Preliminary Pikum Winners will be declared to be final (“The Final Pikum Winners”) and Pikum! will proceed to credit winner(s)’ accounts within a reasonable time thereafter. For example, if you have challenged the Pik result that Kobe Bryant had scored 40 points at the Pikum! Event, and Pikum! has determined that Kobe Bryant had indeed scored 40 points at the Pikum! Event, the Challenge will be rejected, and the Preliminary Pikum Winners will be declared The Final Pikum Winners.

If Pikum! decides that there is merit to a Challenge, a “Challenge Acceptance and Revision of Results” email communicating (i) the nature of the Challenge, (ii) the merits of the Challenge, and (iii) Pikum’s ruling in the matter will be transmitted. At the same time, Pikum! will issue The Final Pikum Winners and will proceed to credit winner(s)’ accounts within a reasonable time thereafter. These determinations will be binding on all Players of the Pikum. For example, if a Player had challenged the Pik result that Kobe Bryant had scored 40 points at the Pikum Event, and Pikum! has determined that Kobe Bryant had only scored 38 points at the Pikum Event, the Challenge will be accepted, and the Preliminary Pikum Winners will be updated to correct the error.

If Pikum! imposes a Continued Evaluation Period, it will continue to study the situation until Pikum!, in its sole and unfettered discretion, is of the opinion that it can make a fair determination of the Event Result. The Continued Evaluation Period can last up to three months. At any time during the Continued Evaluation Period, Pikum! can elect (in its sole and unfettered discretion), to either (i) declare the matter resolved and either accept or reject the Preliminary Pikum Winners Challenge- at which point it will declare The Final Pikum Winners,- which declaration shall be binding on all Players, or (ii) declare the matter irresoluble , cancel the Pikum! and refund all Players their entry fees in full.

For example, if the Preliminary Pikum Winners indicate that Lewis Hamilton has won the Imola Formula One Grand Prix, but FIA (Federation International des Automobiles, the Formula One’s Governing Body) commences an investigation into the compliance of Schumacher’s tyres with FIA regulations after the race is over, Pikum! will likely issue a Challenge. If FIA completes its investigation two weeks later and decided that Hamilton had indeed used tyres that didn’t comply with FIA regulations, that he would therefore be disqualified from the race and Fernando Alonso is declared the actual race winner, Pikum! will declare the matter resolved and issue the Final Pikum Winners based on Alonso being the race winner.

Pikum Winners

Pikum! Winners are determined according to (i) the host’s chosen payout structure and (ii) the player’s Pikum! score. Players are ranked from highest to lowest by their Pikum score and are paid the amount that corresponds to their rank in the chosen payout structure.

A payout structure is selected by the host of each Pikum during the Pikum creation process. The system defaults to the standard payout structure which will pay the top 5 players based on a payout table. Hosts can also select from a list of alternative payout structures including Top 10 Players, Top 3 Players, and Winner Take All. Once the first Player has participated in the Pikum!, neither the payout structure nor any other component of the Pikum! can be changed by the Pikum’s host.

PRIVACY POLICY

This Privacy Policy is applicable to any personal information, which is given to Pikum! by players and hosts via the Pikum! Website. This Policy is devised to help you feel more confident about the privacy and security of your personal details.

Data Collection

To deposit funds and place bets on Pikum!, you will be asked to enter player information. Such player information will only be used for the purposes as set out in this Privacy Policy.

By entering your player information, you accept that Pikum! may retain your information and that it may be held by Pikum! or any third party company which processes it on Pikum!s behalf.

Pikum! reserves the right to perform statistical analyses of player’s behaviour and characteristics in order to measure interest in, and use of, the various areas of the Pikum! site and, in addition, to inform advertisers of such information as well as the number of players that have been exposed to or who have clicked on their advertising banners. We will provide only non- personally identifiable aggregated data from these analyses to third parties.

You agree that (unless you request Pikum! to not do so by pressing the appropriate button on the registration page) you do not object to Pikum!, our associated companies, business partners or third parties contacting you for any of the above purposes whether by telephone, e-mail, fax or in writing. You confirm that you do not and will not consider any of the above as being a breach of your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999.

If you choose to provide us with personal information, you expressly consent to us transferring that information to, and storing it on, servers located outside of the United Kingdom and/ or the European Union (“Other Territories”). As part of this process we may transfer your personal information to our holding and subsidiary companies, associated parties and service providers. The laws on holding personal data in Other Territories may be less stringent than the laws applicable to the United Kingdom and/ or the European Union, but we will transfer and store your information in a safe, confidential and secure environment.

Disclosure

We shall be entitled to sell or otherwise make available your information in order to send information about Pikum! and Pikum!s affiliates, associated companies and organisations, for the following purposes including but not limited to:

  • promotional and/or marketing material about products, services and offers;
  • market research or compliance;
  • transfers to third parties as required;
  • any requirements imposed by applicable law; and
  • AGCC (Alderney Gaming Control Commission which regulates the e-Gambling on behalf of the Alderney States) will have unrestricted access to all player’s personal details

We are not responsible for any actions or policies of any third parties who request your information and you should check the applicable privacy policy of such third parties.

You should assume that all use of the Pikum! website, and emails, instant messages and telephone calls between you and Pikum! will be recorded. These recordings will be the sole property of Pikum! and may be used as evidence in the event of any dispute or to improve customer services.

Cookies

You should be aware that information and data may be automatically collected through the use of Cookies. "Cookies" are small test files that store basic information that a website can use to recognise repeat site visits and as an example, re-call your username if this has been previously supplied. We may use this to observe behaviour and compile aggregate data in order to improve the websites, target advertising and assess general effectiveness of such advertising.

Cookies do not attach to your system and damage your files. If you do not want information collected through the use of Cookies, there is a simple procedure in most browsers that allows you to deny or accept the Cookie feature. Note, however, that "personalised" services may be affected if the cookie option is disabled.

Security

Security is very important to Pikum! Secure Socket layer ("SSL") encryption technology is used for protection of information in transit for any sensitive transactions such as payments. Additional security procedures are in place to protect the confidentiality, integrity and availability of your information.

We reserve the right, at any time, to modify, alter, or update this Privacy Policy.

Recording of Calls

In the interests of customer and staff protection and to assist us in resolving queries, many telephone calls to our Customer Service help lines are recorded on security tape and may be monitored.


Data Controller

PWL Alderney Ltd is the data controller with regard to the processing of Pikum!s users’ personal information . Pikum’s is registered as such with the Guernsey [DPA] under Registration Number 011640.
